1. How to Participate
No purchase necessary. Before submitting a Photo or Video to the Thermostat Challenge, anyone submitting an entry (“Entrant”) must read and agree to the following rules and regulations (“Rules”). Participation constitutes an Entrant’s full and unconditional agreement and acceptance of the Rules.
1.2 Sponsor and Administrator
The sponsor is Polar Bears International (“Sponsor”) (PO Box 3008 Bozeman, MT USA 59772) The Challenge will be administered by the Sponsor and/or its contracted agencies.
The Challenge is open to all those over the age of 13 years old as of January 1, 2013.
Entrants must sign a release and acknowledge that they have read and understand the rules. Minors must have their parent’s permission to participate.
To be eligible for inclusion in the Gallery, Entrants must submit a photo or video demonstrating how they are helping polar bears with an energy-saving action and must successfully fill out the required fields of the entry form.
1.4. Challenge Overview:
Polar Bears International invites Entrants to complete an Entry (“Entry”) which includes an online entry form (“Entry Form”) and media submission (“Submission”). The media submission must adhere to the following guidelines:
• Be a maximum of 300 MB
• Be an original work authored, produced or filmed solely by the Entrant
• Include the Entrant’s story on how they’ve taken the Thermostat Challenge to help polar bears through an action.
• Be in English
1.5. Challenge Period
The challenge period begins on February 6, 2013 at 9:00 AM CST and ends in mid-March. Submissions will be accepted for inclusion in the Gallery for the duration of the pledge period using any of the following methods.
1.6. How to Enter
To be included in the Gallery, Entrants must visit www.myplanetmypart.com and submit a photo or video demonstrating an energy-saving action that will reduce their carbon footprint, along with brief text explaining the action. Entrants must acknowledge that they have read, understood and agreed to the Rules by checking the box that appears on the Entry Form. Upon acceptance of the Rules, the Entrant can upload his or her Submission to the website at www.myplanetmypart.com. In order to be eligible, all required fields in the Entry Form must be completed and the Photo or Video Submission must adhere to the guidelines described in section 1.4. Each Entrant hereby acknowledges that his/her Submission is an original work authored by the Entrant, and that all intellectual property and other proprietary, publicity and privacy rights in the Submission are either owned, have been licensed or, in the case of privacy rights and moral rights waived by the Entrant (collectively the “Rights and Licenses”). By entering, each Entrant agrees that all of his/her Rights and Licenses in the Submission are assigned to and vested in the Sponsor, including, but not limited to, the right of the Sponsor to use, publish, distribute, edit and publicly display the Submission. Entrants and the Sponsor hereby acknowledge there is no relationship between the Sponsor and the owner of any trade-marks displayed in photos submitted by the Entrants. Submissions must be produced, filmed or authored by the Entrant. Submissions may not be offensive, nor can they defame or invade upon the publicity or privacy rights of any person, or otherwise infringe on any person or entity’s intellectual property, personal or proprietary rights, as determined at the sole discretion of the Sponsor. Submissions which depict intellectual property, personal or other proprietary elements that are not owned or which do not appear to be owned by the Entrant (such as, but not limited to, music, individual names, voices or likenesses, and trade-marks or logos) may be subject to disqualification or editing by the Contest Sponsor in its sole discretion. Entries that do not adhere to these Rules may be disqualified at the sole discretion of the Sponsor. All Entries must be submitted and received by 11:59:59 (PDT) on March 15, 2013 in order to be eligible. The Sponsor’s database clock will be the official timekeeper for the challenge. If a dispute results as to the identity of an Entrant, it will be determined that the eligible Entrant is the authorized account holder assigned to the unique email address listed in the Entry Form
3. General Rules
Polar Bears International and any of its partners in this contest will not be responsible for: (a) any late, lost, misrouted, garbled, distorted or damaged transmissions or entries; (b) any challenge-related disruptions, injuries, losses, or damages caused by events associated with the challenge by PBI or its partners; (c) any printing or typographical errors in any materials associated with the Pledge; (d) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (d) if a communications failure or other disruption occurs near the deadline date for entries, it is up to the discretion of PBI and its partners to determine whether the deadline will be extended and to when; (e) PBI has the sole discretion of judging and all decisions are final without repeal or release of judging notes or final scores.
3.2. General Release
By submitting your Challenge, you release the Sponsor, any of its respective parent companies, subsidiaries, affiliates, directors, officers, employees, and agencies and the Parties and respective parent companies, subsidiaries, affiliates, directors, officers, employees, and agencies from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Challenge or delivery, mis-delivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses, and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
3.3. Use of Participants’ Name, Likeness, etc.
Except where prohibited by law, your submission constitutes permission to use your name, state or province, likeness, and/or prize information, without limitation, for promotional purposes without further permission or compensation.
3.4. Affidavit & Release
As a condition of participating, or being awarded any prize, except where prohibited by law, Entrants will be required to execute consent to the use of their name, address, likeness and/or information, without limitation, for promotional purposes without further permission or compensation.

PBI holds the copyright on the Challenge and all accompanying materials. All rights reserved.
The Challenge and these Official Rules will be governed, construed, and interpreted under the laws of the state of California. Entrants agree to be bound by these Official Rules and by the decisions of the Sponsor, which are final and binding in all respects. The Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend or cancel the Challenge or any Entrant's participation in the Challenge should viruses, bugs, unauthorized human intervention, or other causes beyond PBI's control affect the administration, security or proper play of the Challenge or the Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Pledge as planned. Entrants who violate these Official Rules, tamper with the operation of the Challenge or engage in any conduct that is detrimental or unfair to the Sponsor, the Pledge or any other entrant (in each case as determined in the Sponsor's sole discretion) are subject to disqualification from entry in the Gallery.
